As you are aware the captioned matter was listed for hearing along with Writ Petition No.9471 of 2019 filed by City Centre Mall Pvt. Ltd. challenging the impugned resolution passed by the Nashik Municipal Corporation before the division bench comprising of Their Lordship Hon’ble Justice S. C. Dharmadhikari and Hon’ble Justice G. S. Patel at which time the following were present: –

a. Mr. Shriniwas Pathwardhan a/w. Mr. Bhooshan Mandik appeared on behalf of the Petitioner in Writ Petition No.7248 of 2019 [i.e. ICC Realtors (India) Pvt. Ltd.];

b. Mr. V. A. Thorat, Senior Advocate a/w Ms. Divya Shetty i/b. Nankani Associates appeared on behalf of the Petitioner in Writ Petition No.9471 of 2019 [i.e. City Centre Mall Pvt. Ltd.];

c. Mr. S. B. Talekar appeared on behalf of Respondent No.2 in Writ Petition No.7258 of 2019 [i.e. Pune Municipal Corporation];

d. Mrs. Reema Salunke appeared on behalf of Respondent No.1 in Writ Petition No.7258 of 2019 [i.e. State of Maharashtra];

e. Senior Advocate Dr. Milind Sathe a/w Mr. Bhushan Deshmukh, Ms. Bindi Dave, Raghav and I appeared on behalf of the Applicant/ Intervenor in Writ Petition No.7258 of 2019 [i.e. Shopping Centres Association of India (SCAI)];

f. Ms. Ronita Bhattacharya appeared on behalf of the Applicant/ Intervenor in Writ Petition No.7258 of 2019 [i.e. NGO];

g. Mr. Murlidhar Laxman Patil appeared on behalf of Respondent No.1 in Writ Petition No.9471 of 2019 [i.e. Nashik Municipal Corporation]; and

h. Mrs. Ashwini A. Purav appeared on behalf of Respondent No.2 in Writ Petition No.9471 of 2019 [i.e. State of Maharashtra].

At the time of the hearing, the Hon’ble Court informed Mr. Talekar and Mr. Patil that since the Petitioners in the aforesaid writ petitions had raised questions of law which required proper judicial consideration, the Hon’ble Court shall admit the aforesaid writ petitions and further direct the Pune Municipal Corporation and the Nashik Municipal Corporation to refrain from enforcing the Impugned Resolutions/ Circulars.

At this time, Mr. Talekar stated that he was willing to make a statement to the effect that the Pune Municipal Corporation shall not take any steps to enforce its Impugned Resolution. Accordingly, the Hon’ble Court recorded Mr. Talekar’s statement and admitted Writ Petition No.7248 of 2019. The Hon’ble Court further clarified that in the event the Pune Municipal Corporation takes steps to enforce the Impugned Resolution, the parties shall be at liberty to apply to the Hon’ble Court for interim reliefs to stay the effect and operation of the Impugned Resolution.
